Hart e a justificação da punição: retribuição como distribuição

O presente texto tem como objetivo analisar o problema da justificação da punição, uma vez que esse tema tem demandado atualmente a preocupação da filosofia. A partir da relevância dessa discussão, analisar-se-ão as vertentes do retributivismo, do consequencialismo e, principalmente, a visão conciliadora proposta por Hart. Para tanto, propõe-se o estudo da sua obra Punição e Responsabilidade, aplicando-se as categorias do autor na explicação do motivo da prática da punição, ao contexto da pena na atualidade.
