Quem é o guardião do orçamento? O papel do Supremo Tribunal Federal no constitucionalismo financeiro

This text emphasizes the importance that the protection of public budget has been assuming in the contemporary constitutional context and its implications in constitutional jurisdiction, situating this phenomenon within the scope of so-called financial constitutionalism. In this context, it is observed that the budgetary impact has become a fundamental element of decision-making processes. In light of this, returning to the Weimar Debate, this text aims to reflect on the role of the Brazilian Supreme Court in the context of financial constitutionalism, questioning whether the Constitutional Court would be the “Guardian of the Budget”.
