Abstract

We propose a theoretical-practical reflection on the judicial realization of Law in the context of mediatization. We articulate the concepts of mediatization, judicial activism and judicialization to answer questions formulated in the course of observing the interrogation of former President Lula by judge Sérgio Moro. The research privileges the singularity of the case. Theories are applied in the service of understanding what happens in the case, observing the subjects participating in the analyzed episode. In methodological terms, we make upward and downward movements - from the case to the concepts and from these to the case in which we are tentatively elaborating potentially generalizable formulations for the understanding of the communicational and judicative practice in the context of mediatization. The case shows social processes mediated by the jurisdictional provision in which the activation of communicational logics in mediatization generates tension in the face of the legally standardized
