The audience of custody and its role as a constitutional instrument for the effectiveness of rights

This article deals with the institution, in Brazil, of the custody hearing (also called a presentation hearing) from a perspective of a custodian. It is a qualitative research structured from the theory of fundamental rights and protection of the dignity of the human person. In order to do so, the authors analyze the established rules for the custody hearing in international human rights treaties, as well as their incorporation into the Brazilian legal system. In the same way, the authors analyze the situation of the Brazilian prison system and possible violations of fundamental rights in it. Following, the authors specifically address the custodial audience and its importance in the realization of rights, presenting its final considerations.
