Differences and similarities between the theories of Rudolf Smend and Konrad Hesse on the fundamental rights' interpretation

Abstract

The main purpose of this study is to analyze the differences and similarities between the constitution’s theories of Rudolf Smend and Konrad Hesse with a particular attention to the interpretation of fundamental rights. Beginning with the strict connection between constitutionalism and fundamental right presenting the prevalent ideas in the two theories and at the end evaluate how the theories of Smend and Hesse aren’t exactly opposite and have many points in common, especially on the fundamental rights interpretation. The review of aspects of the two theories may be useful in the difficult task of giving greater effect to these rights.
