Ideology as a determinant of legal hermeneutics

Abstract

This paper discusses the relation between ideology, as defined by several theses, and legal hermeneutics, seen here from the perspective of language and interpretation. It examines some concepts related to discourse analysis, such as Karl Marx’ concept of alienation, and some aspects of their reception in Brazilian scholarship. By broadening the list of interpreters of the legal norm, including social actors, even though not in a strict sense, it is possible to better understand reality and its complex relation with the social tissue in which it takes place.

Martonio Mont’Alverne Barreto Lima, Universidade de Fortaleza - UNIFOR

Possui graduação em Direito pela Universidade de Fortaleza (1988), Mestrado em Direito (Direito e Desenvolvimento) pela Universidade Federal do Ceará (1993) e Doutorado em Direito (Rechtswissenschaft) - pela Johann Wolfgang Goethe-Universität Frankfurt am Main (1998), sob a orientação do Prof. Dr. Wolf Paul. Pós-Doutor em Direito pela mesma Universidade de Frankfurt/M., sob orientação de trabalho da Profa. Dra. Ingeborg Maus. Atualmente é Professor Titular da Universidade de Fortaleza e Procurador do Município de Fortaleza. Foi Coordenador do Programa de Pós-Graduação em Direito/Mestrado e Doutorado em Direito Constitucional da Universidade de Fortaleza (1999-2006); Vice-Presidente da Ordem dos Advogados do Brasil - Secção do Ceará (2004-2005), Procurador-Geral do Município de Fortaleza (2006-2012) e Coordenador da Área de Direito na CAPES (2011-2014). Tem experiência na área de Direito, com ênfase em Direito Constitucional. É Professor Titular da Universidade de Fortaleza, Procurador do Município de Fortaleza, atuando principalmente nos seguintes temas: Supremo Tribunal Federal, jurisdição constitucional, Poder Judiciário, democracia brasileira e direito constitucional e história do pensamento constitucional brasileiro. Publicou sua tese de doutorado em 1999 (Peter Lang Verlag, Frankfurt/M): Staat und Justiz in Brasilien - zur historischen Entwicklung der Justizfunktion in Brasilien: Kolonialgerichtsbarkeit in Bahia, Richterschaft im Kaiserreich und Verfassungsgerichtsbarkeit in der Republik. Autor de diversos ensaios, pareceres e traduções publicados, é também organizador de obras.

Atualmente realiza estágio Pós-Doutoral na Universidade de Marília - UNIMAR. Tem experiência na área de Direito, com ênfase em Direito Constitucional, Direito Internacional e Direitos Humanos.
