Teoria, interpretação e dogmática dos direitos fundamentais em Ernst-Wolfgang Böckenförde

Abstract

O texto trata dos direitos fundamentais na obra de Ernst-Wolfgang Böckenförde. Com base em quatro de seus artigos, são retratadas primeiramente as posições centrais de Böckenförde e seu desenvolvimento ao longo do tempo. Na sequência, é apresentada uma classificação na qual as particulares posições teóricas de Böckenförde aparecem ligadas ao seu trabalho como magistrado no Tribunal Constitucional Federal alemão. Finalmente, é examinado qual o significado da obra de Böckenförde para a atualidade.
