Psychological Reports in Custody Dispute: characterization and quality indicators

In cases of psychological forensic the psychological report becomes a legal instrument, that must be presented to the magistrate. The main objective of this article was to verify how the reports arising from psychological forensic investigations in dispute of custody. It was analyzed 45 processes of custody dispute from five Family Law Offices of Rio Grande do Sul, containing 54 psychological reports in a technical-scientific. The criteria for analyzing the documents were defined from the Resolution of the Federal Council of Psychology No. 007/2003. For this, a protocol for data collection of custody dispute processes was developed, exclusive to this study. It was found that most of the psychological reports analyzed did not have the technical-scientific quality recommended. Analyzing documents written by psychologists offers indicators on the gaps in the training of this professional, which can result in significant difficulties in the psychological assessment process, especially in a legal context, which can directly influence the life and future of the examinees.
