The genesis of Fundamental rights in the Chilean 19th century constitutionalism

Abstract

The objective of this paper is to provide the reader and the students of Latin American constitutionalism with a panoramic overview on the genesis of fundamental rights in Chile on the 19th century within pre-constitutional documents and constitutions according to liberal ideas. The study here presented points out the Cádiz 1812 constitution as the starting point for the Iberian American constitutional dialog. Chile has also suffered deep influences from the Argentinian liberalism through the ‘1837 generation’. The impact of this generation ideas in South America might be compared moderately with Pericles century in Athens. Macro-comparison puts on display a rich political exchange between the lands involved, leading towards the development of political and democratic institutions.
