The Construction of the State of Exception in Benjamin, Schmitt and Agamben: Theoretical Dialogues and Implications for Contemporary Legal Thought

The theory of the state of exception has become one of the main theoretical frameworks for understanding state abuses in contemporary times, being used by researchers to explain phenomena that transcend Constitutional Law, reaching areas such as Criminal Law, Administrative Law, Economic Law, Health Law, and Criminology. This bibliographic article aims to analyze the construction of the concept of the state of exception in Walter Benjamin, Carl Schmitt, and Giorgio Agamben. It initially examines Benjaminian thought on violence (Gewalt) and its relationship with power; then, it addresses Schmittian theory, in which the state of exception is included in Law through sovereign decision; and finally, it presents Agambenian theory, which combines elements from the previous authors with Foucauldian biopolitics, demonstrating how sovereign decision creates a zone of indistinction between Law and fact. It is concluded that, although they start from common assumptions, the three authors present fundamental distinctions: while Schmitt seeks to adapt the exception to the legal system, Benjamin places it outside and beyond Law, and Agamben understands it as a permanent structure that exposes life to sovereign arbitrariness.
